I can tell you what is the situation regarding Microsoft licences.
If you purchased Windows Servers with OEM licence, you cannot install the
operating system on any other server (even though it has no OS) OEM licences
are attached to hardware, so you cannot transfer that licence to another
computer.
If you purchased other licences, not OEM, it dependes on the type of DRP
Site you are installing.
In a hot site where you must have your servers up and running, you must buy
new licences for those back-up devices in addition to the licences of the
original servers.
If you decide to have stand-by servers, ready to run, they should be
licenced, even though they are shut down.
The only case you do not need to buy a new licence is to have your back-up
server without the operating system installed, waiting the primary server to
crash to install the same licence in the back-up server. But this option
won´t be very usefull in many cases to recover soon from a disaster. You
will have to analyze the criticality of the services to make a decition.
There is only one exception in Microsoft to this scheme: SQL
SQL considers the active-passive scenario, where the passive licence is free
whenever is up or down.

It depends on the vendor. *Most* will let you do this as long as it's
not active-active DR (IE, you're not running both concurrently).
