In the first case of its kind, a California video game maker is suing an entire community of software tinkerers for reverse engineering and modifying Xbox games that they legally purchased.

Note that they were not publishing "derivative works" -- e.g. modded copies of the game -- which would be covered under traditional copyright protection. They were publishing instructions or "kits" for other owners of the game to effect the mods on their own.
