This is a clear case of an ex-employee retalitating against his former employer.
This is the core basis of the case, not bug disclosure. Had he not sent the emails to the SERVER OF HIS FORMER EMPLOYER there would not be the case courts in this matter.

If you read the brief the prosecutor said that had he said "Have a nice day" or "Tornado is great" there wouldnt have been a case. The prosecutor himself said this was over content.
