Heckenkamp Challenges Computer Ban

Accused eBay hacker Jerome Heckenkamp is back in federal court in California this month, but it isn't for his ever-slipping trial date. His attorneys are mounting a constitutional challenge to court-ordered pre-trial restrictions that have kept him from computers and the Internet since his indictment nearly three years ago.

The key point here, IMNSHO, is that he hasn't been convicted. Maybe he will be, but this country is headed (maybe already there) in the wrong direction when the government can restrict basic rights without even convicting someone....

It's depriving him of the right to earn a living with his skills during his "free" time, of his right to attempt to track down the people who he alleges used his computer to mount the attacks he's accused of, and his right to communicate in his chosen modes (email, online communities). I however, do think that whenever you put a name in all capital letters. It immediately puts whoever is reading it on the defense. How would you like your name spelled out JAMES HOOVER. It's almost as if they were yelling at you. And it does not make your case any better....

First of all, if any of you care to read the transcript, it was not due to the challenge of the ALL CAPS that the judge decided to incarcerate him.

Second, It was when he challenged the court to state WHO his accuser is, that the judge decided to remand him into custody. The 6th Amendment guaran...

Dude people shouldnt be charges with internet crimes. They dont realize what they are doing when they are doing it unless they have lots of money and are ripping people off from ebay then this is a crime. Ebay should be kept safe from all illegal activities....

i truly belive he could have his case throun out of the courts by simply showing the courts how easy it could be for some one to spoof an ip address and to hack in computer using a masked ip,,,,, even the professionals out there selling to the goverment security software is using that line ...
