I thought, in previous precedent, requiring a user to provide a password or passphrase for encryption was a violation of the 5th amendment- thus already protected under the constitution.
That could fall into 1st, 4th, 5th, and quite possibly the 6th, 7th and 8th... But that's assuming the Bill of Rights means something to the US government....
