The current length of copyrights protection, which is the publisher's lifespan plus 75 years is totally unreasonable. Within 125 years, the US went from preserving the Union to winning thwo world wars plus the Cold War and become the planet's hyperpower. Within the last 25 years, the PRC went from f...

What is clear about this issue is that the law is in error, not to mention the intention of the corporations involved. Law of commerce is supposed to aid society and follow *it's* predelections. In a functioning optimal capitalist system (so the theory goes - although learned people know that such...

It always surprises me how on the other side of the big pond so much emphasis is laid on national (US) treaties.
Come folks there's also the rest of the world and the prevailing copyright treaty is the Berne Convention of which US is a signatory.
Without going into great lengths: international law...

In this case, national law would apply as the US has a term of protection in excess of what the Union agreed upon:

article 7, section 6

The countries of the Union may grant a term of protection in excess of those provided by the preceding paragraphs

The free market is a tough thing to manipulate. Just ask the Recording Industry Association of America, which has gone to great lengths to avoid changing its business model and profit margins, but has failed miserably.

The industry's latest strategy is to attack college students who have music f...

Actually, you can easily get a CD-burner for under the cost of 2 CDs. At the same time, in many areas you can also get high-speed internet for around the cost of two CDs. So it's cheaper than you mentioned.

Some record companies, however, such as Magnatune (www.magnatune.org) are adopting a new...

This can all be fixed with a little Congressional magic. All we need is to convince Congress to alter the duration of copyrighted and trademarked protection from the current length to "Life of the original author or creator plus 25 years." Chances are, after 25 years that copyright or trademark of a...

I'm curious, for as long as I've can remember, IRC and newsgroups have offered up pirated software. 4 or so years ago when the MP3 scene took off IRC channels galor started offering these files up. This is not a new issue, it just appears to be a new issue for the RIAA. Novell and AutoDesk used t...

"Canadian Law: Does Copying is Theft ...Apply Internationally?" 2003-08-01
Doug in Canada

Canada has a scheme for permitted private copying of music. There is a levy paid on blank media that goes to the artists in proportion to sales (so if sales for your CD are 0.0083% of all Canadian sales, you get 0.0083% of the money in this pot). It's annoying for consumers in that they have to...

So, all this said, what if person A and person B both have the same CD and person A gives a MP3 version of it to person B because he/she doesn't have the abilty to convert CDA's to MP3's. The author who is wrong about almost every other legal fact in this screed, is correct in one particular: Copying is not theft. Duh. Technically, it's more akin to counterfeiting, where the reproduction of a work degrades the value of all the legitimate copies, whose chief value lies in their rarity...

I don't understand. But I think piracy could have been fought by means of computer espionage, i.e., unsuspectingly monitoring data the computer receives. Usually, lawsuits are filed only if the "pirated" works are sold. If artists want to have piracy be dealt with, then I think that it should be the...
