One thing about this confuses me. You can enter a "Community Chat" in AOL Instant Messenger that I assume in some way mirrors the normal AOL Chats. AOL Intstant Messegner also comes with a "logging" function built right in. So couldn't an argument be made that the perpetrator should've been aware...

I pretty much agree with that. All major IM software programs have the ability to log conversations. Last time I checked, ICQ was the only one where logging was enabled by default.

OMO, it brings another interesting point - "all sides involved" - if the chatroom _is_not_private_, the policy-anim should obtain _everybody's_ concent, should not they?

As a non-american it made me think what the real crime here was? Since the "14-years old girl" wasn't really 14 what exactly made it illegal?

a court requires specifics in order to issues wiretapping (or any other really) warents. Therefore for this more forward there would have to be a specific investigation involving the person that was being recorded.

Law enforcment looks at this as essentially the same thing as when a cop dresse...

By default, everyone should be aware that anything you type in an instant message can be copied and/or logged based on the person(s) options you are chatting with. The entrapment issue is a different subject matter....

The AOL software allows for session logging, which allows for IM logging as well, and Chat room Logging, which logs everything in a chat room, but not the Instant messages. You can turn both on in the AOL Software, and log the entire AOL session, emails read, IM's, chats, boards read, etc.

With electronic communications, the only way to prove you have an expectation of privacy should be that the communication is encrypted. Maybe everyone will get over their belief that PGP is too hard if they realize how easy it is for someone to record their communications....

It gets even more muddied when you consider third party clients like Trillian and GAIM that allow one to connect to multiple chat services simultaneously, overriding the normal default behavior of the original proprietary client. You could argue that a person chatting directly to you is already in consent.

There is no way to receive a message without it being recorded electronically in some fasion.

Sending a message in a public chat room means you consent to everyone having a record of that conversation.

I am not sure about the specific instant messenger programs quoted in the article, but generally don't all IM arguably record the conversation?

There is a chat window, it has a complete record of the entire conversation, and when you close that window you choose to discard that recording. I don'...
