Go (or go back) to law school. It is not a crime to delete spyware. At worst for the consumer, it may be a breach of contract (license agreement), but that as you say is a tort not a violation of criminal law.

Advice to spyware authors: Write your code so that if the user uninstalls your information gathering/disseminating garbage it also removes whatever goodies you lured them in with in the first place.
Advice to anti-spyware authors: Write your code to be a software uninstaller and market it as such...
