Achtung! New German Laws on Cybercrime

Germany is passing some new laws regarding cybercrime that might affect security professionals. Federico Biancuzzi interviewed Marco Gercke, one of the experts that was invited to the parliamentary hearing, to learn more about this delicate subject. They discussed what is covered by the new laws, which areas remain in the dark, and how they might affect vulnerability disclosure and the use of common tools, such as nmap.

According to the wording of paragraph 202c even every person that gets infected by a trojan horse/botnet that distributes itself from the infected system comits a crime.

Already we're suffering the effects of this ill-advised law. To wit:

- phenoelit.de has closed down. They've been an excellent source of research and security resources. That's the end of that.

- kismac.de is about to close down. The best wireless sniffer for Mac OS X is about to lose its ...

Paragraph 202c Penal Code does not limit the criminalisation to tools that are primarily designed to commit certain computer crimes.


By this rationale anyone under the jurisdiction of this new law could be in violation simply by having a web browser on their machine.
