Aye, Robot, or Can Computers Contract?

A contract is usually described as a "meeting of the minds." One person makes an offer for goods or services; another person sees the offer and negotiates terms; the parties enter into an agreement of the offer; and some form of consideration is given in return for the provision of something of value. At least that's what I remember from first year law school contracts class.

Nicely written! I have to say I enjoy your articles. They really make us think of the quagmire of legal entwinements we would otherwise just ignore. As with all legal issues, we really need to know what we are getting ourselves into BEFORE we agree....

Yes they can. You can set up your robots.txt file to disallow robots. If you combine this with a commented copyright notice in the robots.txt file, the robot owner is violating your terms of use if he knowingly circumvents your robots.txt file...

Actually, Asimov already did the generalization in his novel "The Evitable Conflict" (1950) thought it has different meaning.

... so that the First Law becomes: "No Machine can harm humanity; or, through inaction, allow humanity to come to harm"...
