Mark Rasch, 2008-03-04

On February 7, 2007 Stephanie Lenz of Gallatzin, Pennsylvania posted an innocuous video of her 18-month-old son Holden pushing a baby toy while dancing to a barely recognizable song in the background.

These tedious legal diatribes are really getting old. Get back to IT security centric columns....

You are a nuff nuff. Nuff said. These "tedious" legal issues are how you lose your rights, one by one by one. Idiot....

Perhaps it's not what you intended to convey, but comments like these give credence to the thought that the IT department killed IT. IT is about providing solutions to the needs of their customers: the marketing, product development, and revenue generating portions of the company.

As a security ...

The legal environment is extremely important to the IT security world. I've personally found Mr. Rasch's commentary very inciteful and well written.

I hope that these articles continue to appear here. ...

This legal stuff drives me nuts, too, but that's hardly Mark's fault. Criticizing him is like shooting the messenger....

Mark was never criticized by me. I am simply tired of reading about legal matters, even if are about IT. This is why the company has a lawyer. As an aside to one of the commenters to me. Grow up, and act professionally. Insulting someone really isn't becoming an adult or a professional. I'm rather s...

Mr. Rasch typically posts one article every few weeks with insight and quality research into pertinent legal topics that I have no doubt many find interesting. I look forward to them. Hard for me to understand why you would click on the links even read them if you find the topics tiresome, but as ...

I was wondering if your comment that not anyone would file such a lawsuit was tongue-in-cheek (and suspect it was).

A little reading about Scientology versus the Internet reveals some excellent examples of the kind of legal problems you're talking about, though.

Distributing copies of music to thousands of people when you don't own it was illegal before the internet existed so this isn't a you tube thing.

Had she recorded this on VHS and sold it at flea markets in the mid 80's it still would have been illegal and gotten her sued just as vigorously if a ...

I emphatically disagree. Fair use is a non infringing use even if the copyright holder denies you permission to use their work. Indeed, that is the whole point of the balance between the copyright holders' rights and those of users to make fair use. Congress has long determined that non-commercia...

Very Interesting - but, how would you apply this to persons phishing bank websites? Would you still want an automated process looking for copyrights (logos) and taking these sites down? Or would you want to go through the "legal process"?...

I have no problem with an automated tool looking for potential infringement. But an automated tool looking for and then taking down any reference to my corporate name or logo would create the same problem as an automated tool taking down my copyrighted content. There are many non infringing uses of...

It is clear Universal has a right to raise a lawsuit against Mrs. Stephanie Lenz.
It is completly within the right of the company to ask Mrs. Lenz to remove the video.
Universal clearly represents Mr. Prince and his monetary interests, and the company is contractually obligated to threatan Mrs. Le...
