First off, downloading a tool from a site is not illegal. Second, scanning networks under current law is not a crime. Lastly, law enforcement goes fishing to obtain clues in many different fashions, as a security professional and former cop, I understand what they were looking for but do not understand the fumble on the supeonas, it is a simple document that requires an eight grade education to complete. DOD handles scanners a little different and I wish all ISP's would do the same. One scan okay, two scans and a temp block, third scan and you are out! There is nothing more annoying than having some snot nosed moran scanning your system and having Intruder Alert sounding off. I think everyone should have the "legal" right to delete hard drives of those morans that do the scans against you!
