Shhhh. U.S. appeals USA PATRIOT loss

The U.S. Justice Department is appealing a decision that trimmed back the FBI's powers under the USA PATRIOT Act. But in a case already noted for unusual secrecy, the very fact of the government's appeal was kept under seal for over two months.

It's more of a case of, "if you knew we knew", then it would put the government in a worse position to obtain more evidence from a legal prespective, since the "suspect" would no doubt cease and desist.

It will be interesting to see how this plays out... we know that the goverment needs the ability to do things, but doesn't it seem that there should be some significant definitions as to what, when and where this type of "search and seizure" is applicable beyond the "we think he could be a terrorist" without further information. It doesn't have to be information we see, just assertable information outside of the same branch of government. Hence the three branches of governemt, one specifically required to function as oversight.

They are slowly redefining "right to privacy"... a balance of notification, oversight and auditing could keep these powers inline.

We'll see...
