This is a horrible idea. We should not be trying to accomplish with legislation what can be accomplished with technology. The epidemic is not a general problem in computing. It is mainly affecting the experiences of one operating system family's user base. If Mac, Linux, BSD, and UNIX users can manage to get by without anti spyware legislation, why should its ramifications be shoved down our throats simply because the users of Microsoft Windows continue to subject themselves to the known flaws and dangers of using that operating system. It is not the governments job to equal the playing field of computer security.
