Let's remember one thing: All Gilmore has to do is add SMTP authentication and his friends can still send their mail from anywhere without spammers being able to abuse his server.

The right of free speech here is balanced against the fact that -- unlike traditional junkmail -- the *recipient* of the spam pays a larger cost than the sender. The ISP I use at home (PacBell.net!) has had several occasions where floods of spam from multiple spammers has caused their mail servers to crash.

Should I be forced to pay a higher cost for a dialup ISP so that you can have the right to use an archaic and wholly unnecesary misfeature of the SMTP protocol?
