The right of free speech here is balanced against the fact that -- unlike traditional junkmail -- the *recipient* of the spam pays a larger cost than the sender. The ISP I use at home (PacBell.net!) has had several occasions where floods of spam from multiple spammers has caused their mail servers to crash.
Should I be forced to pay a higher cost for a dialup ISP so that you can have the right to use an archaic and wholly unnecesary misfeature of the SMTP protocol?
