Don't forget, he had worked VOLUNTARILY with the FBI prior to this whole smack-down. Yes, the FBI held a gun to his head to cooperate. Yes, the FBI practiced a nasty game of blackmail when Max decided to pull back, but look beyond the simple picture.

He was guilty of a punishable crime regardless of his cooperation.

He was a mole in the hacker-world - turning in hackers left and right just to save his own behind.

He only put on the brakes when the person he was supposed to rat on happened to be his friend. So, some semblance of loyalty popped into his head and he balked. It wasn't just some faceless "joe" that he was putting the hit on anymore. Wow, how admirable. It's not like that should inspire THAT much sympathy.

Yes, the FBI wasn't playing nice....downright low-down actually. But Max was a rat caught in a trap of his own devising.
