What max did was illegal and even he admits that it was wrong. On the other hand he has provided a great service to the internet community.

Perhaps whitehats should push for formal premission to allow people like max and the cheese worm author to penetrate to close holes. Intent is generally a major element in punishment for a crime. It does not appear that the judge took max's intent into account. To put this into perspective what would you do if you neighbor was leaving his garage open and criminals were using it to store stolen cars. Would it be illegal to go into the garage and put in an automatic door closure which locked out the criminals? YES it would be but I suspect most judges would give you a hand slap at worse.
