Actually I think they're trying to find cracked and copied software, in addition to keeping tabs about what you do.

As far as spying on us, or Windows being an illegal trojan, couldn't they say "...you chose to install it, or not Uninstall it and use Linux etc... ".

They have the money and legal 'expertise' to argue this for as long as they have to, or until you run out of money.
