This is a non-story, don't you think? Someone claims there may be a legal problem, and maybe it is an interesting academic discussion (10 minutes max, prefereably down the pub), but I don't believe that there will ever be a case that makes it to prosecution where someone cracks a system, fails to see a banner, and complains that his IRC conversations have been intercepted. So, to answer the question posed by the headline: No, you won't.
