Don't get me wrong. I'm against the legal concept of strict liability attaching to ISP/ASPs if their customers commit illegal acts (i.e., the blantantly unconstitutional US anti-porn legislation of the early 90s). However, if the TOS simply becomes a cover-your-ass mechanism for lazy ISPs like Verio (yes, they suck), then the US Congress may be pressured to step in again with ill-conceived legislative "solutions" that screw the industry.
If the Verios and SBCs of the world don't act not only to quickly disconnect customers hosting this crap, but also to *proactively* hunt down abuse in their networks, eBay should sue the freakin' bejeezus out of them. After all, it's not like employees at Verio aren't getting tons of the same email sh*t the rest of us have to put up with.
