Ok, so owning the roms without owing the original arcade game IS illegal, but...
1).
Most, if not all of these games are not even being made/sold nymore, so its not like any company is suffering loss of profits or anything...
Mind you, the author of Robby Roto (Jay Fenton) actually got the copyrights for the game back, since his contract specified that he would get the rights back if the sales dropped below a certain level, and he DONATED the rom to the MAME project. See his authorization at http://www.mame.net/romsrobby.html

Some of these companies have gone bancrupt ages ago, like Atari. Bankrupt companies are not gonna suffer loss of profit anyway, so...
