Fair comment, except there's more at stake than embarrassment. Corporations are entitled to take the risk in not protecting their systems. They are entitled to someone not attacking their vulnerabilities. It's one thing to exploit their vulnerabilities - it's another to offer them help"
This is like saying one is entitled to their house not being broken into and then not investing in locks. Having locks at least reenforces in the courts eyes that if they are bypassed in an improper manner that permission wasn't given. Otherwise it ends up as a "he said/she said" situation. Also one is expected to a certain degree to be responsible for protecting oneself and ones property. Negligence is still a viable reason for dismissing a case.
Also as far as the stories concerned, permission was given
Maybe it shouldn't have, but it was.
Third he does help out companies that he's entered. That's a lot more than what any cracker will ever do.
