Um, if the NBC reporter asked him to hack NBC, how is he breaking the law? It would be reasonable for him to assume at that point that since he had been asked to hack NBC's system by a representative of NBC that his activity was perfectly legal.

If the reporter didn't have the authority to ask him to do the hacking, it would seem to be the reporter's problem at this point.
