SACRAMENTO, Calif.--A federal judge ordered Adrian Lamo released to his parents' custody Tuesday afternoon, but barred the hacker from using computers, and ordered him to obtain full-time employment pending trial.

You don't walk into people's houses and tell them that their door was unlocked, so it's okay, you're just there to show them how to lock the door.
While his actions may be morally defensible, legally, they are not.
Going with my example above, if the homeowners elect not to press any charges, the police will probably leave you alone. But in Adrian's case, the homeowners have apparently filed a complaint, so law enforcement is responding.
