Heckenkamp Challenges Computer Ban
Kevin Poulsen, SecurityFocus 2003-12-03

Accused eBay hacker Jerome Heckenkamp is back in federal court in California this month, but it isn't for his ever-slipping trial date. His attorneys are mounting a constitutional challenge to court-ordered pre-trial restrictions that have kept him from computers and the Internet since his indictment nearly three years ago.

It's depriving him of the right to earn a living with his skills during his "free" time, of his right to attempt to track down the people who he alleges used his computer to mount the attacks he's accused of, and his right to communicate in his chosen modes (email, online communities). I think it's placing a serious restriction on his ability to adequately defend himself. He's not in jail. He's released on bail. He's innocent until proven guilty.
