A raid on the alleged author of a well-known hacker toolkit is raising eyebrows among electronic civil libertarians, and putting security researchers on guard.

If prosecution is brought against him for the toolkit, then the the manufacturer of the compiler/assembler/linker he may have used should share the docket with him.. (tools, aiding and abetting, 'used in the comission of a crime', etc. would reasonably apply, I should think.) So, it probably won't come to that (pressure on judges from monied OS vendors). Might be interesting, though, should it come to pass .
