Just some quick thoughts on the matter. There are a large number of assumptions going on here. I'll just cut to the chase. The writers of the program assumed anyone downloading files of such a nature are pirates. That makes them irresponsible in the collection of data. They also collected data on the end user without their permission. The users aren't without blame, but that doesn't mean that the programmers are immune to blame.

Simply put, these "bad pirates" that the software are probably just some kid who hopped on the internet to download something. The "real" pirates pay alot more attention to what they download and execute. I think all this will do is establish who are the dumb pirates out there.
