I believe that the illegal and questionable planting of these type executionables in software will completely complicate the prosecution of software pirates. If a seized computer is found to have that program imbedded, defense attorney's will have a field day with the factual issue of the defendant's intent. Call it misdirection, but to some extent, the defendant's ability or inability to control a situation takes on evidentiary significance with relation to the defendant's intent, and evidence of the defendant's intent will be questionable in this case, and insufficient to support a conviction...so, chalk one up for the pirates....
