Think of this possiblity....some naive person fires up their wifi enabled XP laptop in the parking lot. Let us imagine that they have it setup to use any available network...they have a cluttered desktop, hit the IE button and are on the Internet.
I know a little imagination is needed there, but it could happen. Based on this result, I know of a lot of people that could end up getting convicted just because they want to see if they can use the unprotected wifi connection to surf. Yikes...this sends the wrong message. The other 2 should be convicted, no questions asked.
