Warspammer guilty under new federal law

A Los Angeles man who used other people's wi-fi networks to send thousands of unsolicited adult-themed e-mails from his car pleaded guilty to a single felony Monday, in what prosecutors say is the first criminal conviction under the federal CAN-SPAM Act.

Spamming is illegal, & I'm all for prosecuting him for that crime. But "wireless hacker"? I have a wireless PDA that automatically syncs my email if I'm in a hotspot. No special hardware or software, just an off-the-shelf iPaq 4150. Am I a "wireless hacker" too? Hardly. These days there are MANY companies installing unsecured APs (on purpose) as a service to their customers. For someone to put up an unsecured AP & then complain when someone else connects to it is just beyond comprehension.
