SACRAMENTO, Calif.--A federal judge ordered Adrian Lamo released to his parents' custody Tuesday afternoon, but barred the hacker from using computers, and ordered him to obtain full-time employment pending trial.

I mostly agree with your point of view, however, there is one thing I think he should've thought about a little harder. The arcticle says "he ran up a $300,000 bill". He should've thought about that one a little harder. When you cost a bank 300K, you best believe they'll do what it takes to find you...
