Actually, all of the caselaw goes the other way. The lead case involves someone who bought a Gateway computer, and it arrived with a form contract inside, saying that the purchasor had agreed to binding arbitration and the only way to avoid it was to send the entire computer back. The court held that the contract was enforceable.
