Lets say in the apartment building down the road some hooligans break into the basement and decide to move in. The landlord never comes to the building unless the tennants complain, and these new tennants are stealthy enough to avoid detection. A bit far fetched, but a much closer example to whats going on with a worm than anything else presented so far.
So the landlord isn't really responsible for what they do, in fact, they are tresspassing oon his property! If he knew they were there, he wouldn't be happy.
SO these hoopligans, based from his basement, go around trying to break into nearby houses (leaving their own biuilding alone since they don't want to draw attention to their own illegal residence)
Do you think you have the legal right, as some random schmo who lives up the street to take a baseball bat and walk down to this place and exorcise these hooligans from the basement?
Hell no. In fact, even the landlord can't do it. He has to call the police and have them come and do it. If he goes down there with a baseball bat and tries to threaten them to leave, thats assault with a deadly weapon.
This is the difference between the rule o flaw and vigilantism.
Now all that said, this isn't really the case either. As they are launching attacks from the basement ditrectly. I could certainly see, depending on HOW its done, the claim that this is analogous to self defense, oif it was done in quick response to stop an active attack. However, in general, this is why we have police in the first place.
