Interesting issues whether it's legal or not to unleash certain types of 'digital' warfare. I am more inclined to think that it is indeed legal under the present circumstances (assuming the war itself is legal). I have written an article on the legalities of counterstrike, which includes a brief discussions of the law of armed combat and cyberwarefare, as part of my keynote speech at Blackhat.
