As for the Code Red example, yes, eEye was drinking code red. They still named it as they saw fit. That is to say, the team that found it, named it. Same for Sapphire (who cares if the name took or not? It did mildly, and both teams release very close in timeframe as to not have been aware of the others work.)
One primay example, Morris, was the worm named after the author. Your points don't exactly hold up. First to disassemble names it. Period.
