This can all be fixed with a little Congressional magic. All we need is to convince Congress to alter the duration of copyrighted and trademarked protection from the current length to "Life of the original author or creator plus 25 years." Chances are, after 25 years that copyright or trademark of a non-corporate entity (a person) will be useless; for corporations that want to sit on intellectual property the law would be for as long as the company exists plus 25 years. And make all copyrights and trademarks non-transferrable.
