As much as I hate spam, and would like to take the computer away from those that answer to spam, there is no judicial law in the physical world stopping people from sending slow mail to you. There is no such a thing as trespassing your physical mail box. It would be a big stretch to make it any different in the internet.
In the same physical world analysis, if you put your TV on the side walk, there is no law to stop strangers from watching it with you, even if you don't want them to. If you want privacy, put the TV inside the house or make your website private.
The lawyers knew they were going overboard and when they realized that the ISP didn't know the game, they should have scaled back their request on their own. They lawyers are guilty and the author's fears are unfounded.
