This article proposes some very good ideas. I do think we have the right to strike back.

This will, however, bring up a whole new array of problems, just like the "self defense" principle does in case of people attacking eachother. At which point is it OK to use self defense? What is reasonable force? Plus, if you have the same incompitent admins performing the self defense, it might be a lot less than precise and graceful. Unless some VERY clear cut laws are made (and they won't be), this will just equate to a lot more money for the lawyers.
