It could potentially be a crime, if authorisation is interpreted narrowly to mean only that which is acceptable to the authorisor. Breaching or exceeding authority are problematic areas for a number of jurisdictions. A tightly worded end-user agreement could quite easily push this type of activity into the criminal.

Certainly the decision appears flawed, if only on the interpretation of damage.
