One thing about this confuses me. You can enter a "Community Chat" in AOL Instant Messenger that I assume in some way mirrors the normal AOL Chats. AOL Intstant Messegner also comes with a "logging" function built right in. So couldn't an argument be made that the perpetrator should've been aware that someone in that chat room could be using AIM and therefore could be logging the chats (a la the ICQ exemption)? Or are these chat services kept seperately and don't interact? Just my 2¢.
