It gets even more muddied when you consider third party clients like Trillian and GAIM that allow one to connect to multiple chat services simultaneously, overriding the normal default behavior of the original proprietary client. In other words, even if AOL IM doesn't have logging by default, Trillian does, so one party might have given this implicit consent while the other didn't.
