But do not explore this exemption in your article. Yet you clearly state that getting a wi-fi connection is "use". Therefore it seems that just obtaining internet wi-fi access to an unguarded access point fits within this exception if all one is doing is surfing the net and not trying to easedrop on packets from that access point.
Secondly, I thought it was decided in Federal Court long ago, that intercepted voice communications from a cordless phone with no encryption was not protected. The same as CB radio communications are not protected. Therefore, if the access point is transmitting in plain text, how is this different? It's radio communication of a plain "voice" sort.
