A: Because someone was convinced that by using it they could make money.
If we can make this answer not true then spyware should go away on its own, as there would be no point to creating it. We need to find a way to convince everybody that there is no money in spyware.
This same solution could be used for spam prevention as well. Even if the actual spam doesn't make any money, someone was convinced that if they bought 1,000,000 emails on CDROM or whatever that they could sell their product/service and make money. We need to educate enough people so that they realize that this isn't true, or make it so that it isn't true. Until then I don't think the spyware or spam problem will go away.
