They've strong-armed themselves into a near monopolist position and then abused their implicit responsibility by leaving their customers (captives) open to compromise. IANAL, but it seems to me they've cost American business millions (billions?) in lost productivity. And then what have they cost the individual consumer?
They've gotten off easy, by my thinking.
