There is a vast ocean of encryption schemes available which would effectively defeat any measures built into the system. Like the man said, they may get access, but just to a bunch of encrypted gibberish. Government regulations will never be able to keep up with an army of dedicated code designers sitting up all night every night trying to defeat them.
The "law enforcement agencies" are just wasting time and tax-payer $$$ with this futile tilting at windmills, they need to realize that the world has changed, and just maybe they can't do anything about it.
