Assuming for a moment that the pollution analogy is correct, then let's look at the correct way to solve the problem.

We currently spend millions or billions of dollars 'cleaning-up' oil spills, chemical spills, toxic waste or whatever when it escapes into our physical environment. Do we then just pat the offending parties on the back and watch them go run another tanker aground? No - we fine and/or sue the hell out of them. This has the effect of encouraging the offending party to clean up their act, as it is in their own financial best interest.

If the ISP's are unwilling to police the traffic because it costs them profits, then I'd suggest we give them some gentle financial encouragement to begin doing so.

The O/S argument is tired and stale - you'll never get anywhere telling _people_ what they /should/ do. Some will, some won't - so what? The corporate ISP's on the other hand have a vested interest in providing service and covering their liabilities. I suppose M$ could be included in that pool as well.

This is the only viable solution to the problem I can see. Huh - never thought I would advocate for _more_ lawyers... LOL.
