So allow me to expand on the seatbelt example. In order to liability, you would have to prove to a jury that the manufacturer of the car (a) knew their design/production was flawed and (b) willfully ignored it. I'd love to see someone prove that with Microsoft and security features. It would take a single internal memo that says "... I know there are major security holes, let's ignore them". That, if brought before a jury, would show willful negligence, and hence, prove MS at (or anyone, for that matter) at fault for the security risks posed. Now - I won't claim to be a lawyer, but I've researched the issue - and that's my conclusion.
