After a week of well-deserved criticism, Lycos is abandoning its scheme to launch denial-of-service attacks against spammy websites. Did the company reform in time to avoid criminal prosecution?

Compromised (Stolen) host resources are used to send spam and host spam sites dns and web content. Reverse proxy and dns load balancing technologies are employed to distribute the website.
Ironically the spammers might contribute to the technology development for fault-tolerant and massively distributed websites since they are under constant pressure to stay alive.
So Lycos were misinformed and their quest was naive at best.
