Advertisements on radio, television, in the
movie theaters, in newspapers and magazines,
even on webpages help offset your costs when
you use those media. In those cases the
advertisement subsidizes the users.

Not so for spam. Spammers pay nothing to
YOUR isp, their advertising is subsidized
by you, the user.

That is precisely why it is the UNSOLICITED
nature of spam that makes spam evil. The
fact that laws do not recognize this is the
unfortunate reason why spam is only illegal
when it is ALSO fraudulent.

One should also be aware that the statutory
damages for email fraud are not intended to
offset actual economic harm. Their purpose
is to disabuse the sender from a repetition
of the act, some mere compensatory damages
could not do.
