Would a SPIM Law Actually Have Purpose? 2005-03-01
Matthew Murphy
Let's look at the actual merits of CAN-SPAM for a moment. I know that I am not alone in the realization that legislation is bound to backfire. Look at what has happened in the post-mortem of CAN-SPAM. Junk e-mail has *_surged_*. Why? Because the U.S. government has now legitimized junk mail *within non-deceptive parameters*.

I don't know about anyone else, but I want nothing to do with junk e-mail, deceptive pretext or not. The same can be said for unsolicited IMs. I want NOTHING to do with them, under any circumstances.

Any law on the subject is bound to legitimize the right to spam in some business-oriented circumstances. That is a right that simply DOES NOT EXIST, and until the legislatures recognize that, no law will ever be effective.

In essence, until the U.S. Congress pulls its hands out of its pockets, lined by liberalized corporate lobbies, and begins to truly put its foot down, its actions are not only doomed to fail, Mr. Rasch, but they are the enemy of those who seek useful reform. Until it is recognized that honest junk is still junk, keep the lawyers and legislators as far away as possible from my PC.
